1. INTRODUCTION

Welcome to West Yorkshire Safety Barriers Ltd. ("WYB", "we", "us")! These Terms & Conditions ("Terms") govern your use of our website (https://westyorkshiresafetybarriers.co.uk/) and the purchase of our safety barriers and related products ("Products"). Please read these Terms carefully before you place any orders. By accessing or using our website or purchasing Products, you agree to be bound by these Terms.

DEFINITIONS

 " the Company", “WYB”, "we", "us", “our”, - West Yorkshire Safety Barriers Ltd.

“Credit Account” – Any sale which is agreed at the absolute discretion of the Company with a customer by which payment for the sale of goods is delayed or deferred to a specified due date by issue of an invoice.

“Product” – any product, services or goods purchased from or supplied by West Yorkshire Safety Barriers Ltd

2. ACCEPTANCE OF TERMS

By accessing and using the West Yorkshire Safety Barriers Ltd WooCommerce Shop you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please refrain from using the Shop.

2. ACCEPTANCE OF ORDERS

2.1 We reserve the right to accept or reject any order at our sole discretion.

2.2 A Contract (the “Contract”) for the purchase of Products will be formed only when we dispatch them to you and these Terms and Conditions apply to the Contract between.

2.3 The Contract will relate only to the Products confirmed for dispatch in the order acknowledgment email.

2.4 We may cancel your order if the Product(s) is/are unavailable or unavailable in the quantity requested. In such cases, we will provide you with a full refund.

3. PRICES AND PAYMENTS

3.1 All prices shown on our website are inclusive of VAT at the current rate.

3.2 We accept payment by credit/debit card and bank transfer.

3.3 Payment must be made in full at the time of ordering.  

3.4 We reserve the right to change prices at any time without prior notice. The final price, including taxes and shipping, will be provided at checkout.

3.5 Credit Accounts are available at the absolute discretion of the Company and time is of the essence in respect of payment by invoice for Credit Accounts; Credit Accounts are subject to the additional terms in respect of payment dates as referred to on the invoice issued and in the event of failure by you to make payment by the due date we reserve the right to terminate our Contract with you.

3.6 Subject to clause 3.5 above, failure by you to make payment under the Contract by the due date, will incur interest on the overdue sum from the due date until payment of the overdue sum. Interest under this Clause will accrue each day at a rate of 4% a year above the Bank of England’s base rate from time to time, but at 4% a year for any period when that base rate is below 0%.

4. DELIVERY

4.1 Delivery times are estimates and may vary depending on the Product(s) ordered and your location.

4.2 We will endeavour to deliver within the estimated timeframe, but we cannot guarantee specific delivery dates.

4.3 Larger or bespoke orders may have longer lead times due to manufacturing requirements.

4.4 You are responsible for any import duties or taxes that may apply to your order.

4.5 We are not responsible for delays or issues caused by third-party delivery services.

5. RISK AND DAMAGE

6.1 Risk of damage to or loss of the Goods shall pass to the you:

6.1 In the event of collection from our premises at the time when you collect the Goods; or

6.2 In the case of Goods to be delivered on behalf of the Company, at the time of delivery or, if you wrongfully fail to take delivery of the Goods, at the time when we have tendered delivery of the Goods.

6.2 It is your responsible to check the delivery upon receipt, for example in relation to condition, damage and number of packages received, prior to signing the goods receipt with the delivery agent. Any claims in respect of items claimed to be in poor condition, damaged at point of delivery and/or undelivered will be void immediately upon signature of goods receipt with delivery agent.

5. RETURNS AND REFUNDS

5.1 Please refer to our "Cancellation, Returns, and Refunds Policy" for detailed information on returning products, cancelling orders, and obtaining refunds.

5.2 You must contact us directly by telephone and email before returning any item and items should not be returned to our registered office address.

6. PRODUCT WARRANTIES, MANUFACTURERS GUARANTEES AND DISCLAIMERS

6. 1 The Company is not the manufacturer of the products sold on this website, however we strive to maintain up to date product information on our online Shop but all information on our website is for information purposes only. Please ensure you check all labels, warnings, instructions, directions and warranty instructions provided by the manufactuer in relation to the product prior to installation and use. Customers should refer to the manufacturer for further information in relation to warranty and guarantee information.

6.2 We make no warranties or representations express or implied with respect to the Products their suitability for any particular purpose or their compliance with any laws or regulations.

6.4 We will not be liable for any loss or damage direct or indirect arising from or in connection with the use of the Products.

7. LIMITATION OF LIABILITY

7.1 Our total liability under these Terms will not exceed the amount paid by you for the Product(s) that give rise to the claim.

7.2 West Yorkshire Safety Barriers Ltd is not liable for any direct indirect incidental special or consequential damages resulting from the use or inability to use the Shop and/or any of its products sold via the Shop or via Credit Accounts.
